Terms of Service & User Agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Top Trades USA, LLC governing your access to and use of our web platform and services.

1. Acceptance of Terms

By creating an account, publishing a business profile, submitting a job request, or using Top Trades USA, you affirm that you are at least 18 years old and agree to comply with these Terms and our Privacy Policy.

2. Platform Intermediary Role

Important Notice: Top Trades USA is a directory, lead connection, and meritocratic ranking platform. We are NOT a licensed general contractor, employer, or party to any service agreement between homeowners and contractors.

All home repair, remodeling, or trade contracts are negotiated directly between the consumer and the contractor. Top Trades USA does not guarantee project completion, workmanship quality, or pricing negotiated between parties.

3. Contractor Representation & Licensing

Contractors registering on Top Trades USA represent and warrant that:

  • They hold valid, active trade licenses in all jurisdictions where required by state or municipal law.
  • They maintain appropriate commercial general liability insurance where represented on their profile.
  • All profile information, state license numbers, and insurance certificates submitted are accurate and truthful.
  • Falsification of credentials will lead to immediate account termination and public consumer alert badges under FTC guidelines.

4. Homeowner Contact & Communication

Homeowners may contact contractors using public phone numbers or service request forms. Top Trades USA does not restrict direct communication via phone or SMS using public contractor contact details. However, users agree not to use platform communications for unlawful purposes, spam, or harassment.

5. Review Authenticity & FTC Rules

In compliance with FTC Endorsement Guides:

  • Reviews must reflect genuine first-hand experiences of actual home projects.
  • Paid, incentivized, fake, or self-submitted reviews by contractors or their agents are strictly prohibited.
  • Top Trades USA reserves the right to request proof of work (receipts, contracts, photos) and remove non-compliant reviews.

6. Subscriptions, Billing & Cancellations

Contractors subscribing to premium tiers agree to recurring monthly or annual billing handled via Stripe. Subscriptions renew automatically unless cancelled prior to the billing cycle end date via the Customer Portal. Refunds are issued in accordance with our billing policy or where required by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP TRADES USA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM OR CONTRACTOR SERVICES RENDERED.

8. Governing Law & Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding individual arbitration in Albuquerque, New Mexico, rather than in court.
